All of our solicitors at KMJ are members of Resolution, an organisation of family practitioners numbering 6500 family law professionals, that focuses on the non-confrontational resolution of family law matters. Everyone in the team at KMJ is committed to the Resolution Code of Practice which “promotes a constructive approach to family issues and considers the needs of the whole family.”
Throughout your case, wherever appropriate, we will negotiate with the other party to endeavour to reach an agreement that is fair and beneficial to you. When necessary, proceedings will be issued and robustly progressed, with negotiation usually continuing in tandem with the court proceedings. We are skilled negotiators but have the experience and knowledge to guide you through court proceedings.
Negotiation can be used to attempt to resolve a variety of family law issues. In financial matters, there will usually be full and frank disclosure of each party’s financial positions before negotiation can commence.
Skilled negotiations culminating in an agreement will deliver an outcome that you and the other party have reached, as opposed to having one imposed upon you by a court or arbitrator. This is likely to cost much less than a fully contested hearing in terms of the funds expended on lawyers and experts, the emotional toll and the time spent engaged in those proceedings.
